Welcome to the website of LOYA B.V. ("LOYA", "we", "us" or "our").
These Terms of Use apply to the use of www.loyadiamonds.com and the associated digital environments of LOYA.
By using the website, the user must comply with the rules for permitted use. Orders, products and paid services are separately governed by LOYA's General Terms and Conditions.
These Terms of Use relate exclusively to the use of the Website. The purchase of products and services is governed by the separate General Terms and Conditions of LOYA B.V.
1. Use of the Website
You may use this Website only for lawful purposes and in accordance with these Terms of Use.
The following conditions apply to the use of the Website:
- Placing an order or creating a MYLOYA account is permitted only from the age of 18. Minors may only use the website under the supervision of a parent or legal guardian.
- The information you provide must be accurate and complete;
- You will not use the Website for unlawful purposes.
2. Permitted Use
You may use the Website only for:
- Viewing products;
- Requesting information;
- Placing orders;
- Managing your account;
- Communicating with LOYA;
- Using MYLOYA, where applicable.
3. Prohibited Use
It is not permitted to:
- Hack the Website;
- Distribute malware or viruses;
- Circumvent security measures;
- Copy the Website;
- Automatically collect content (scraping);
- Use robots or spiders;
- Reverse engineer software;
- Provide incorrect information;
- Impersonate another person;
- Infringe the intellectual property rights of LOYA or third parties;
- Use the website in a manner that may disrupt its operation.
LOYA may temporarily restrict access to public parts of the Website where this is necessary due to misuse, security or maintenance. Article 4 applies to the blocking or termination of accounts.
4. Account and MYLOYA
A personal account may be required for certain services.
You are responsible for:
- Keeping your password confidential;
- All activities within your account;
- Reporting unauthorised use immediately.
LOYA may temporarily block or terminate an account in the event of fraud, misuse, a security incident or a serious or repeated breach of these terms. Unless immediate blocking is necessary, LOYA will inform the user in advance of the reason and give the user a reasonable opportunity to remedy the breach.
5. Intellectual Property
All rights to the Website belong to LOYA or its licensors.
These include, among other things:
- The LOYA brand name;
- MYLOYA;
- E-Love;
- Logos;
- Photos;
- Videos;
- Product designs;
- Software;
- Texts;
- Illustrations;
- Graphic design;
- Source code;
- Databases.
No part of the Website may, without prior written permission, be:
- Copied;
- Published;
- Distributed;
- Modified;
- Used commercially.
It is also not permitted to use the Website or any part of it for training artificial intelligence, machine learning models or similar technologies without the prior written permission of LOYA.
Reverse engineering of the software or underlying systems is prohibited to the extent permitted by law. It is also not permitted to use content from the Website to develop, train or improve generative AI models or similar technologies without the prior written permission of LOYA.
6. Information on the Website
LOYA strives to keep all information up to date and correct.
Despite the utmost care, inaccuracies may occur.
LOYA does not guarantee that:
- All information is complete;
- Prices are always up to date;
- All products are available;
- The website functions without errors.
Obvious typographical, pricing or system errors may be corrected by LOYA. However, specific product characteristics, prices and commitments that have become part of an order or order confirmation remain binding. This provision does not limit any statutory consumer rights.
7. Product Information
Product images, 3D renders and AI-generated visualisations are for illustrative purposes only.
Because every Memorial Diamond is unique, the following characteristics, among others, may vary:
- Colour;
- Clarity;
- Cut;
- Size;
- Carat weight;
- Inclusions.
No rights can be derived from images.
Colour rendering may differ due to screen settings, lighting conditions and photography. Production-related variations do not constitute a defect insofar as they fall within reasonable tolerances communicated in advance. This does not apply where the product does not conform to the agreed specifications, the order confirmation or the statutory conformity requirements.
8. Links to Third Parties
The Website may contain hyperlinks to third-party websites. LOYA is not responsible for the content, security, privacy, products or services of these external websites. Use of third-party websites is at your own expense and risk. This does not limit LOYA's responsibility for links or external services that it itself offers as part of a paid service.
10. Privacy
LOYA processes personal data in accordance with its Privacy Statement.
By using the Website, you acknowledge that you have taken note of this Privacy Statement.
12. Availability
LOYA reserves the right to temporarily take the Website offline for maintenance, security or updates.
LOYA cannot guarantee that the Website will be available at all times without interruption, delay or errors.
LOYA reserves the right to change, expand, restrict or discontinue the Website or parts of it without prior notice.
Changes to or discontinuation of MYLOYA, existing accounts and digital services are governed by the separate MYLOYA Terms of Use and the statutory rules for digital services.
13. Liability
LOYA endeavours to manage the Website carefully, secure it appropriately and keep the information published on it up to date. However, LOYA cannot guarantee that the Website will be available continuously, completely or without interruptions, malfunctions or technical errors.
LOYA is not liable for damage that results solely from:
- temporary unavailability of the Website;
- maintenance or security updates;
- disruptions in public internet or communication networks;
- disruptions at external hosting, cloud or software providers;
- unauthorised acts of third parties; or
- third-party websites or services,
insofar as these circumstances cannot be attributed to LOYA and LOYA has taken reasonable measures to prevent or limit their consequences.
LOYA is liable for damage insofar as:
- there is a shortcoming or unlawful act attributable to LOYA;
- the damage is sufficiently causally connected to that shortcoming or unlawful act; and
- the damage qualifies for compensation under applicable law.
The user must take reasonable measures to prevent or limit damage, including securing their equipment, account and login credentials.
The personal or emotional significance of data, photos, videos or other digital memories does not in itself give rise to an independent amount of damages that can be expressed in money. Any compensation for non-material or other non-financial damage will be determined exclusively in accordance with the applicable statutory conditions.
For business users, LOYA's liability is limited to the amount paid out by LOYA's liability insurer in the relevant case, plus the applicable deductible. If no insurance payment is made, liability is limited to the amount the business user paid to LOYA for the relevant digital service in the twelve months preceding the event causing the damage.
The above limitations do not apply in the event of:
- death or personal injury;
- liability under mandatory product liability law;
- intent or deliberate recklessness on the part of LOYA's management; or
- liability that may not be excluded or limited under mandatory law.
For consumers, this article applies only insofar as its provisions are legally valid under applicable consumer law.
14. Changes
Amended terms apply from the effective date stated therein. Material changes affecting existing accounts or digital services will be communicated in advance in an appropriate manner. Changes do not apply retroactively unless required by law.
15. Governing Law
These Terms of Use are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, unless mandatory consumer law designates another competent court.
16. AI / Scraping
Use of automated systems
Without the prior written permission of LOYA, it is not permitted to use automated systems, including crawlers, spiders, bots, scrapers or artificial intelligence, to collect, copy, analyse or reuse (parts of) the Website, unless this is done in accordance with applicable law.
17. Trademark Rights
LOYA, MYLOYA, E-Love and any other trade names, logos and figurative marks are the property of LOYA or its licensors and may not be used without prior written permission.
18. Precedence of General Terms and Conditions
These Terms of Use relate exclusively to the use of the Website. Purchases, orders and services are governed by LOYA's General Terms and Conditions. In the event of any conflict between these Terms of Use and the General Terms and Conditions, the General Terms and Conditions prevail, unless mandatory law provides otherwise.
