Product Specification & Quality Policy
1. Purpose
This Product Specification & Quality Policy describes the quality standards, product specifications and technical tolerances applied by LOYA in the manufacture of Memorial Diamonds, jewellery and related products.
This Policy supplements LOYA's General Terms and Conditions.
In the event of any conflict between this Policy and the General Terms and Conditions, the General Terms and Conditions prevail, unless mandatory law provides otherwise.
2. Unique Products
Memorial Diamonds are manufactured individually using unique memorial material. As a result, Memorial Diamonds will in practice differ from one another and cannot be regarded as identical products.
Production-related variations are among the characteristics of the product and do not constitute a defect.
3. Laboratory Diamonds
LOYA has Memorial Diamonds manufactured using CVD technology. For each order, LOYA determines, in consultation with the production partner, which method is technically and qualitatively most suitable.
4. Production Tolerances
The tolerances below are regarded as normal within the industry and are taken into account when assessing whether the product conforms to the agreement.
Carat weight
If the final carat weight is lower than the agreed lower limit, LOYA will consult with the customer before delivery about a suitable solution, such as a price adjustment, new production or express acceptance by the customer. The applicable tolerance and any price consequences are made known before ordering.
The final carat weight may deviate from the ordered weight.
Indicative tolerances:
- Up to 1.00 ct: ± 0.08 ct
- 1.00 – 2.00 ct: ± 6%
- Above 2.00 ct: ± 6%
LOYA strives to approximate the agreed carat weight as accurately as possible.
If an independent laboratory uses a different rounding or measurement method, this does not constitute a defect.
Dimensions
Dimensions may deviate slightly depending on:
- Cut;
- Proportions;
- Cut quality;
- Certification standards.
Small deviations resulting from manual finishing, the cutting process or certification standards do not constitute a defect.
Colour
The final colour may be influenced by growth conditions, any colour treatment, the cut and the assessment by the gemmological laboratory. Colour perception also depends on the light source, surroundings and personal perception.
Clarity
Every Memorial Diamond may contain production-related growth characteristics, inclusions or other internal characteristics.
These do not constitute a manufacturing defect.
Growth patterns or other internal characteristics are among the characteristics of a Memorial Diamond.
Fluorescence
Where present, fluorescence is regarded as a natural characteristic of laboratory diamonds.
Cut
The final cut is, insofar as technically possible, produced according to internationally customary cuts.
Minimal deviations in proportions do not constitute a defect.
Measurement methods
In the event of differences between measurement methods or rounding by independent laboratories, the assessment of the laboratory concerned prevails, unless there is a demonstrable administrative error.
5. Colour Treatments
If a customer opts for a coloured Memorial Diamond, internationally accepted treatments may be used to obtain the desired colour.
LOYA informs the customer before the order is placed if a post-growth treatment is applied for the chosen colour. Where possible, the treatment is stated in the product specification or on the laboratory certificate.
Coloured Memorial Diamonds may show a limited natural change in colour over time without this constituting a defect.
6. Certification
Not every Memorial Diamond is provided with a gemmological certificate.
Only where certification is part of the chosen product or is expressly included in the order confirmation will the Memorial Diamond be submitted to an independent, internationally recognised gemmological laboratory, such as IGI or another laboratory selected by LOYA.
LOYA cannot guarantee that every diamond will qualify for certification. The independent laboratory determines the content, assessment and classification of the certificate.
7. Cut Quality
LOYA strives for the highest possible cut quality.
Cut quality may vary depending on the chosen shape.
For fancy shapes (such as heart, pear, marquise or emerald), different international assessment criteria may apply than for round diamonds.
8. Engravings
If an engraving is ordered, the following applies:
- the text is executed in accordance with the text supplied by the customer;
- capital letters, punctuation and spelling are the responsibility of the customer;
- after production, engravings can generally no longer be changed.
LOYA is not liable for errors in texts, names, dates or spelling supplied by the customer.
9. Jewellery
LOYA strives to have jewellery manufactured in accordance with the agreed specifications.
Small deviations in:
- Finish;
- Hand polishing;
- Setting;
- Sizing;
may occur and are regarded as normal production tolerances.
Manual finishing may lead to minor differences between pieces.
Production tolerances do not apply where the deviation materially affects the wearability, durability or agreed appearance of the jewellery.
10. Ring Sizes
LOYA manufactures rings according to the size specified by the customer.
The customer is responsible for the accuracy of the ring size specified.
If resizing is technically possible afterwards, LOYA may charge for this.
LOYA is not liable for an incorrect size provided by or on behalf of the customer.
LOYA does not offer a free first resizing. Any resizing is carried out only after a technical assessment and on the basis of a separate quotation.
11. Precious Metals
LOYA supplies jewellery in the agreed alloy, including among others:
- 14-carat gold
- 18-carat gold
- platinum
- silver (if offered)
Colour differences between different alloys, production batches or later repeat orders are normal.
12. Settings
Every Memorial Diamond is set with customary professional care.
Despite the utmost care, wear may occur through daily use.
LOYA recommends having jewellery inspected annually.
Periodic inspection of settings remains the responsibility of the owner.
13. Quality Control
Every Memorial Diamond and every piece of jewellery undergoes a quality check before delivery.
This check may relate to, among other things:
- identity;
- dimensions;
- cut;
- finish;
- setting;
- engraving;
- cleaning;
- packaging.
The quality check performed does not constitute a guarantee that normal wear or damage cannot occur later.
14. Photography
Product photos, videos, renders and digital images are for illustrative purposes only.
Due to differences in:
- screens;
- cameras;
- lighting;
- colour settings;
the actual colour may differ from what is shown in photos.
Digital visualisations, AI renders and 3D images are for illustrative purposes only.
15. Maintenance
For a long service life, LOYA recommends:
- avoiding contact with aggressive chemicals;
- removing jewellery during heavy physical work;
- storing jewellery separately;
- having jewellery professionally cleaned regularly.
Damage demonstrably caused by failure to follow reasonable maintenance advice may fall outside the commercial warranty. This does not affect statutory conformity rights.
16. No Warranty on Subjective Expectations
A Memorial Diamond is an emotional and unique product.
Subjective expectations relating to, among other things:
- beauty;
- colour;
- brilliance;
- personal appreciation;
- emotional experience;
Purely subjective preferences that are not based on an agreed product characteristic do not constitute an independent ground for termination (rescission). This does not limit the customer's rights where the product deviates from the agreement or from specific statements made by LOYA.
17. Continuous Quality Improvement
LOYA continuously evaluates its production processes, suppliers and quality standards.
LOYA reserves the right to change production processes, techniques and product specifications, provided that this does not materially detract from agreements already concluded.
18. Production Outside LOYA's Sphere of Influence
LOYA uses specialised external laboratories and production partners. Independent laboratories determine their own measurement results and classifications. LOYA remains responsible towards the customer for the agreed characteristics, quality and correct execution of the order.
LOYA has no control over the day-to-day operations or internal quality procedures of these independent parties.
19. Precedence of the General Terms and Conditions
This Policy serves solely to further explain LOYA's quality standards and product specifications. In the event of any conflict between this Policy and LOYA's General Terms and Conditions, the General Terms and Conditions prevail, unless mandatory law provides otherwise. This Policy does not create any additional contractual obligations or warranties, unless LOYA has expressly agreed otherwise in writing.
