Authenticity & Ethical Sourcing Policy

1. Our Vision

At LOYA, we believe that a Memorial Diamond is more than a piece of jewellery. It is a tangible memory of a loved one or a beloved pet and deserves a high standard of care, quality and integrity.

LOYA strives for the greatest possible transparency about the origin, production and delivery of its Memorial Diamonds, insofar as this is compatible with confidentiality, security and contractual obligations.

2. Production

LOYA works with carefully selected specialised laboratories for the production of Memorial Diamonds.

Production may take place in whole or in part at specialised production partners outside the European Union. LOYA does not state the specific country of production as standard.

LOYA strives to work only with production partners that meet the selection criteria applied by LOYA:

• Technical expertise;
• Quality control;
• Reliability;
• Safety;
• Confidentiality;
• Compliance with applicable laws and regulations.

3. Authenticity

The memorial material supplied in accordance with LOYA's instructions is fully incorporated into the production process. Where technically necessary for stable diamond growth, additional laboratory carbon may be added. LOYA does not state a fixed percentage of carbon originating from the memorial material.

4. Unique Characteristics

Every Memorial Diamond is unique.

As a result, differences may arise in, among other things:

• Colour;
• Clarity;
• Cut;
• Inclusions;
• Fluorescence;
• Carat weight.

These production-related variations are inherent to the production process. Production-related variations do not constitute a defect insofar as they fall within tolerances communicated in advance and the Memorial Diamond conforms to the agreed specifications and statutory conformity requirements.

5. Chain of Custody

LOYA applies an administratively controlled Chain of Custody procedure.

Throughout the entire process, administrative checks are carried out wherever possible to promote the identity and traceability of each order as far as possible.

6. Certification

Not every Memorial Diamond is provided with a gemmological certificate.

Only where certification is part of the chosen product or is expressly included in the order confirmation will the Memorial Diamond be submitted to an independent, internationally recognised gemmological laboratory, such as IGI or another laboratory selected by LOYA.

LOYA cannot guarantee that every diamond will qualify for certification or that every laboratory will accept every diamond. The independent laboratory determines the content, assessment and classification of the certificate.

7. Ethical Production

LOYA strives to work with production partners that:

• Provide safe working conditions;
• Comply with applicable labour legislation;
• Are committed to preventing child labour;
• Are committed to preventing forced labour;
• Treat employees fairly;
• Apply appropriate safety measures.

If LOYA receives indications that a production partner no longer meets these principles, LOYA reserves the right to terminate the cooperation.

Where possible, LOYA contractually records its relevant requirements with production partners and may require documentation, declarations or audits to assess compliance.

8. Precious Metals

For our jewellery, we strive to use high-quality precious metals sourced from reliable suppliers.

Where possible, we prefer recycled or responsibly mined precious metals, insofar as commercially, technically and logistically available.

9. Quality Control

LOYA strives to subject every Memorial Diamond to one or more quality checks before delivery.

These checks may relate to:

• Dimensions;
• Cut;
• Finish;
• Setting;
• Engraving;
• Final inspection.

10. Transparency

LOYA strives for open communication about:

• Production methods;
• Expected delivery times;
• Certification;
• Quality.

If unexpected circumstances arise, LOYA strives to inform the customer as soon as reasonably possible.

11. Continuous Improvement

LOYA strives for continuous improvement of quality, sustainability and transparency and reserves the right to periodically evaluate its production processes and suppliers and to adjust them where necessary.

12. Independent Production Partners

LOYA works with independent specialised laboratories and production partners outside the European Union. Independent laboratories determine their own gemmological assessments and classifications. LOYA remains responsible towards the customer for the correct performance of the agreement and for the product characteristics and certification it has agreed with the customer.

13. Not a Warranty Document

This Policy describes LOYA's working methods and quality principles. Specific commitments included in the product specification, order confirmation or agreement remain binding. This Policy does not limit any statutory consumer rights.

14. Amendment of the Policy

LOYA reserves the right to amend this Policy periodically. The most recent version is published on the website. Amendments do not have retroactive effect, unless the law provides otherwise.

15. No Transfer of Ownership

Nothing in this Policy constitutes a transfer of intellectual property rights, trademark rights or other rights of LOYA.

16. Precedence of the General Terms and Conditions

This Policy serves solely to further explain LOYA's working methods and principles. In the event of any conflict between this Policy and LOYA's General Terms and Conditions, the General Terms and Conditions prevail, unless mandatory law provides otherwise. Specific commitments that have become part of the order confirmation or agreement remain binding. This Policy does not limit any statutory consumer rights.
